1. Respect for Intellectual Property
ShadowPhone Inc. respects the intellectual property rights of others and expects our users to do the same. We comply with the provisions of the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, and other applicable copyright laws.
ShadowPhone is a device automation software tool. We do not host, store, transmit, or have access to user-generated content on connected devices. Content created, uploaded, or distributed by users through their devices is solely under the user's control and responsibility.
2. DMCA Takedown Notices
If you believe that content accessible through ShadowPhone's website, documentation, or services (excluding user device activity, which we do not access) infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:
- A physical or electronic signature of the copyright owner or a person authorised to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and where it is located (URL or specific description)
- Your contact information: name, address, telephone number, and email address
- A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorised to act on the owner's behalf

3. Counter-Notices
If you believe that material was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notice to our designated agent. Your counter-notice must include:
- Your physical or electronic signature
- Identification of the material that has been removed or disabled and the location at which it appeared before removal
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal courts in the district where your address is located (or, if outside the US, the Northern District of California) and that you will accept service of process from the person who provided the original DMCA notification
4. Repeat Infringers
In accordance with the DMCA, ShadowPhone will, in appropriate circumstances, terminate the accounts of users who are determined to be repeat copyright infringers. We may also, at our sole discretion, limit access to the Services or terminate accounts of any users who infringe the intellectual property rights of others, regardless of whether there is any repeat infringement.
5. User Responsibility for Content
ShadowPhone does not host, store, transmit, or control user content.Content that users create, upload, post, or distribute through their connected devices is processed entirely locally on the user's machine and connected devices. ShadowPhone has no access to, knowledge of, or control over this content.
Users are solely responsible for ensuring that all content they create, upload, post, or distribute through their devices does not infringe upon the copyright or other intellectual property rights of any third party. This includes images, videos, text, audio, and any other media.
6. Misrepresentation Warning
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees. Please consider consulting a lawyer before submitting a DMCA notice or counter-notice.
